1. DEFINITIONS AND INTERPRETATION

1.1 "We," "Us," "Our" refers to DIY Geek t/a Bespoke & Carvings.

1.2 "You," "Your" refers to the customer purchasing products or services.

1.3 "Bespoke Piece" means any custom-made furniture item created specifically to Your specifications.

1.4 "Ready-Made Item" means stock furniture items available for immediate or near-immediate purchase and delivery.

1.5 "Site" means our website and e-commerce platform.

1.6 "Products" includes both Bespoke Pieces and Ready-Made Items.

1.7 "Order" means Your request to purchase Products through the Site or directly.

1.8 "Deposit" means the non-refundable initial payment required to initiate a Bespoke Piece commission.


2. ACCEPTANCE OF TERMS

2.1 By accessing and using the Site, placing an Order, or purchasing Products, You agree to be bound by these Terms and Conditions.

2.2 If You do not agree to these Terms, You must not use the Site or purchase Products from Us.

2.3 We reserve the right to modify these Terms at any time. Continued use of the Site constitutes acceptance of modified Terms.


3. PRODUCTS AND DESCRIPTIONS

3.1 All product descriptions, images, pricing, and specifications on the Site are provided for informational purposes and are accurate to the best of our knowledge.

3.2 Bespoke Pieces: Custom furniture is handcrafted to Your specifications. Due to the nature of natural materials (hardwoods, resin, glass, steel), slight variations in colour, grain, texture, and finish are normal and expected. These variations are characteristics of artisanal craftsmanship, not defects.

3.3 Material Authenticity: We use genuine natural materials. Live-edge wood, natural resin, and hand-finished surfaces mean each piece is unique. No two pieces are identical.

3.4 Lead Times: Typical lead times for Bespoke Pieces range from 6-20 weeks, depending on complexity, materials, and current order queue. Lead times are estimates only and not guaranteed.

3.5 We do not warrant that products will meet expectations in colour, finish, or exact dimensions if natural material variations occur within acceptable ranges.


4. ORDERING AND COMMISSION PROCESS

4.1 Bespoke Commissions

a) Inquiry & Consultation

  • You submit a commission inquiry via our website or contact form.
  • We will contact You within 2 business days to discuss Your vision, requirements, materials, and budget.
  • This consultation is non-binding.

b) Design & Quote

  • Following consultation, We will prepare a formal quotation including:
    • Design concept/specifications
    • Materials and finishes
    • Estimated dimensions
    • Lead time
    • Total cost
    • Payment terms

c) Acceptance

  • Your acceptance of the quote (in writing, email, or explicit confirmation) constitutes a binding Order.

d) Deposit Payment

  • A non-refundable 70% deposit is required to initiate production.
  • Deposit must be received within 7 days of quote acceptance to secure Your slot.
  • Failure to pay deposit within 7 days may result in cancellation of Your Order.

e) Production

  • Upon deposit receipt, Your Bespoke Piece enters production.
  • We may request Your approval on material selections or design details during production.
  • Reasonable changes requested during production may incur additional costs.
  • Substantial design changes may delay lead times.

f) Delivery Notification

  • Upon completion, You will be notified and a final invoice issued for the balance (30%).
  • The balance must be paid before delivery or collection.
  • Delivery or collection dates will be arranged in advance.

g) Inspection & Acceptance

  • You are entitled to inspect the Bespoke Piece before payment of the final balance.
  • Upon acceptance and final payment, ownership transfers to You.

4.2 Ready-Made Items

a) Purchase Process

  • You select a Ready-Made Item from the Site and add it to cart.
  • You provide delivery address and select shipping/collection option.
  • You review Order summary and complete payment.

b) Order Confirmation

  • An order confirmation email will be sent with order number, items, and delivery details.

c) Pricing

  • Prices are displayed inclusive of VAT and exclusive of delivery costs.
  • Delivery costs are calculated and displayed at checkout.
  • Prices are subject to change without notice, but Your Order is locked at checkout price.

5. PAYMENT

5.1 Accepted Methods: We accept credit card, debit card, and electronic bank transfer as notified at checkout.

5.2 Payment Processing: Payments are processed securely through our payment gateway. By providing payment information, You authorize Us to charge the specified amount.

5.3 Currency: All prices are in South African Rand (ZAR).

5.4 Failed Payments: If payment fails, We will attempt to contact You. If payment is not received within 7 days, Your Order may be cancelled, and Your deposit forfeited (if applicable).

5.5 Refund Policy: Refunds are governed by the separate Returns & Refunds Policy. Bespoke Piece deposits are non-refundable under all circumstances.

5.6 Invoicing: Invoices will be provided upon payment. VAT will be charged as applicable.


6. SHIPPING AND DELIVERY

6.1 Scope: We ship locally within South Africa only.

6.2 Shipping Costs:

  • Delivery costs are calculated based on destination, item dimensions, and weight.
  • Costs are provided at checkout for Ready-Made Items.
  • For Bespoke Pieces, shipping costs are quoted separately and may be included in the final invoice.
  • Customer may arrange their own delivery; costs are the customer's responsibility.

6.3 Collection: You may choose to collect Your Order from Our address (13 Makriel Road, Wadeville, 1422) by prior arrangement. Contact Us to arrange.

6.4 Risk of Loss:

  • For delivered items, risk of loss transfers to You upon delivery to the address You provided.
  • For collected items, risk of loss transfers upon collection.
  • We recommend You inspect items immediately upon receipt/collection.

6.5 Delivery Timeframes:

  • Ready-Made Items: Typically 3-7 business days from order confirmation (subject to stock availability).
  • Bespoke Pieces: Delivered upon completion and payment (as per agreed lead time).
  • Delivery timeframes are estimates and not guaranteed.

6.6 Damage in Transit: If Your item arrives damaged, You must notify Us within 48 hours with photographic evidence. We will assess and remedy at Our discretion (repair, replacement, or refund).

6.7 Lost Shipments: If a shipment is lost in transit, We will investigate with the courier. If unresolved, We will remanufacture/resend the item at no additional cost to You.


7. WARRANTY

7.1 Warranty Period: All Products carry a 30-day limited warranty on workmanship and materials from date of delivery/collection.

7.2 What is Covered:

  • Structural defects due to faulty craftsmanship or material defects.
  • Broken joints, loose components, or assembly failures.
  • Finish defects (e.g., cracks, bubbles, peeling) caused by manufacturing error.
  • Examples: A table leg that breaks due to poor joinery, resin that cracks due to improper curing, finish that peels due to inadequate sealing.

7.3 What is NOT Covered:

  • Normal wear and tear.
  • Damage from misuse, accident, neglect, or abuse.
  • Damage from improper cleaning or maintenance.
  • Damage from exposure to extreme humidity, temperature, or environmental conditions.
  • Damage from moving, transport (after delivery), or improper handling by customer.
  • Fading or colour change due to sun exposure or aging of natural materials.
  • Dents, scratches, or surface marks from normal use.
  • Damage caused by third parties.
  • Modifications made by anyone other than Us.

7.4 Warranty Claims:

  • To claim under warranty, contact Us within 30 days of delivery with photographic evidence.
  • We will assess the claim and, at Our discretion, repair, replace, or refund the item.
  • Warranty remedies are limited to repair or replacement; refunds are not guaranteed.
  • Customer bears no cost for warranted repairs; We cover labour and materials.

7.5 Natural Material Characteristics:

  • Wood grain variation, colour inconsistency, natural knots, and resin flow patterns are normal for handcrafted pieces and are NOT warranty issues.
  • Minor dimension variations (within 5mm) are acceptable and expected.

7.6 Limitation of Liability: Our liability under this warranty is limited to the repair or replacement of the defective item. We are not liable for consequential, indirect, or incidental damages.


8. INTELLECTUAL PROPERTY

8.1 Our Content: All content on the Site (images, text, designs, logos) is Our intellectual property or licensed to Us. You may not reproduce, distribute, or use this content without Our written permission.

8.2 Bespoke Designs: Once a Bespoke Piece is completed and paid for, You own the physical item. However, We retain the right to photograph and display images of Your completed piece for portfolio/marketing purposes unless You request otherwise in writing.

8.3 User Content: You retain ownership of any ideas, designs, or specifications You provide to Us for a Bespoke Piece. By providing them, You grant Us a non-exclusive license to use them to create Your commissioned piece.


9. LIMITATION OF LIABILITY

9.1 To the fullest extent permitted by South African law, Our total liability to You for any claim arising from or related to these Terms, the Site, or Products is limited to:

  • The amount You paid for the item in question, or
  • 100% of the purchase price, whichever is lower.

9.2 We are not liable for:

  • Indirect, incidental, special, consequential, or punitive damages.
  • Loss of profit, revenue, data, or use.
  • Any damages arising from Your use or inability to use Products.
  • Delays or failures to deliver due to circumstances beyond Our control (force majeure).

9.3 Force Majeure: We are not liable for delays or failures caused by events beyond Our reasonable control, including but not limited to: natural disasters, pandemics, strikes, supplier failures, or government actions.


10. CONSUMER PROTECTION

10.1 South African Consumer Protection Act (CPA): These Terms do not limit rights afforded to You under the Consumer Protection Act, 68 of 2008 (South Africa).

10.2 Your Rights: You have the right to:

  • Receive products that are safe, of good quality, and fit for purpose.
  • Receive accurate information about products.
  • Cancel a transaction within a reasonable period (subject to Our Returns & Refunds Policy).
  • Pursue remedies if products are defective or not as described.

10.3 Our Obligations: We warrant that:

  • Products are of merchantable quality (subject to natural material variations).
  • Products will function as described for a reasonable period.
  • Products comply with applicable safety standards.

10.4 Bespoke Pieces Exception: Custom Bespoke Pieces are excluded from standard cancellation rights. Once a 70% deposit is paid and production begins, the Order is non-cancellable and non-refundable, in accordance with CPA Section 16(4)(b) (custom goods).


11. DISPUTE RESOLUTION

11.2 Resolution Attempt: We will attempt to resolve disputes within 14 days of receiving Your complaint.

11.3 Escalation: If unresolved, disputes may be referred to the National Consumer Tribunal or other appropriate dispute resolution body as per South African law.

11.4 Governing Law: These Terms are governed by the laws of the Republic of South Africa. Both parties submit to the jurisdiction of the High Court of South Africa.


12. GENERAL PROVISIONS

12.1 Entire Agreement: These Terms, together with the Returns & Refunds Policy and Privacy Policy, constitute the entire agreement between Us and You.

12.2 Severability: If any provision is found unenforceable, it will be modified to the minimum extent necessary, and remaining provisions remain valid.

12.3 Waiver: Failure to enforce any provision does not constitute a waiver of that provision.

12.4 Assignment: You may not assign these Terms without Our written consent. We may assign these Terms to Our successors.

13. CHANGES TO TERMS

13.1 We may update these Terms at any time. Changes take effect upon posting to the Site.

13.2 Your continued use of the Site or purchase of Products constitutes acceptance of updated Terms.
