1.1 "We," "Us," "Our" refers to DIY Geek t/a Bespoke & Carvings.
1.2 "You," "Your" refers to the customer purchasing products or services.
1.3 "Bespoke Piece" means any custom-made furniture item created specifically to Your specifications.
1.4 "Ready-Made Item" means stock furniture items available for immediate or near-immediate purchase and delivery.
1.5 "Site" means our website and e-commerce platform.
1.6 "Products" includes both Bespoke Pieces and Ready-Made Items.
1.7 "Order" means Your request to purchase Products through the Site or directly.
1.8 "Deposit" means the non-refundable initial payment required to initiate a Bespoke Piece commission.
2.1 By accessing and using the Site, placing an Order, or purchasing Products, You agree to be bound by these Terms and Conditions.
2.2 If You do not agree to these Terms, You must not use the Site or purchase Products from Us.
2.3 We reserve the right to modify these Terms at any time. Continued use of the Site constitutes acceptance of modified Terms.
3.1 All product descriptions, images, pricing, and specifications on the Site are provided for informational purposes and are accurate to the best of our knowledge.
3.2 Bespoke Pieces: Custom furniture is handcrafted to Your specifications. Due to the nature of natural materials (hardwoods, resin, glass, steel), slight variations in colour, grain, texture, and finish are normal and expected. These variations are characteristics of artisanal craftsmanship, not defects.
3.3 Material Authenticity: We use genuine natural materials. Live-edge wood, natural resin, and hand-finished surfaces mean each piece is unique. No two pieces are identical.
3.4 Lead Times: Typical lead times for Bespoke Pieces range from 6-20 weeks, depending on complexity, materials, and current order queue. Lead times are estimates only and not guaranteed.
3.5 We do not warrant that products will meet expectations in colour, finish, or exact dimensions if natural material variations occur within acceptable ranges.

5.1 Accepted Methods: We accept credit card, debit card, and electronic bank transfer as notified at checkout.
5.2 Payment Processing: Payments are processed securely through our payment gateway. By providing payment information, You authorize Us to charge the specified amount.
5.3 Currency: All prices are in South African Rand (ZAR).
5.4 Failed Payments: If payment fails, We will attempt to contact You. If payment is not received within 7 days, Your Order may be cancelled, and Your deposit forfeited (if applicable).
5.5 Refund Policy: Refunds are governed by the separate Returns & Refunds Policy. Bespoke Piece deposits are non-refundable under all circumstances.
5.6 Invoicing: Invoices will be provided upon payment. VAT will be charged as applicable.

6.6 Damage in Transit: If Your item arrives damaged, You must notify Us within 48 hours with photographic evidence. We will assess and remedy at Our discretion (repair, replacement, or refund).
6.7 Lost Shipments: If a shipment is lost in transit, We will investigate with the courier. If unresolved, We will remanufacture/resend the item at no additional cost to You.
7.1 Warranty Period: All Products carry a 30-day limited warranty on workmanship and materials from date of delivery/collection.

7.6 Limitation of Liability: Our liability under this warranty is limited to the repair or replacement of the defective item. We are not liable for consequential, indirect, or incidental damages.
8.1 Our Content: All content on the Site (images, text, designs, logos) is Our intellectual property or licensed to Us. You may not reproduce, distribute, or use this content without Our written permission.
8.2 Bespoke Designs: Once a Bespoke Piece is completed and paid for, You own the physical item. However, We retain the right to photograph and display images of Your completed piece for portfolio/marketing purposes unless You request otherwise in writing.
8.3 User Content: You retain ownership of any ideas, designs, or specifications You provide to Us for a Bespoke Piece. By providing them, You grant Us a non-exclusive license to use them to create Your commissioned piece.
9.1 To the fullest extent permitted by South African law, Our total liability to You for any claim arising from or related to these Terms, the Site, or Products is limited to:

9.3 Force Majeure: We are not liable for delays or failures caused by events beyond Our reasonable control, including but not limited to: natural disasters, pandemics, strikes, supplier failures, or government actions.
10.1 South African Consumer Protection Act (CPA): These Terms do not limit rights afforded to You under the Consumer Protection Act, 68 of 2008 (South Africa).

10.4 Bespoke Pieces Exception: Custom Bespoke Pieces are excluded from standard cancellation rights. Once a 70% deposit is paid and production begins, the Order is non-cancellable and non-refundable, in accordance with CPA Section 16(4)(b) (custom goods).
11.1 Communication: If You have a complaint or dispute, contact Us in writing at:
11.2 Resolution Attempt: We will attempt to resolve disputes within 14 days of receiving Your complaint.
11.3 Escalation: If unresolved, disputes may be referred to the National Consumer Tribunal or other appropriate dispute resolution body as per South African law.
11.4 Governing Law: These Terms are governed by the laws of the Republic of South Africa. Both parties submit to the jurisdiction of the High Court of South Africa.
12.1 Entire Agreement: These Terms, together with the Returns & Refunds Policy and Privacy Policy, constitute the entire agreement between Us and You.
12.2 Severability: If any provision is found unenforceable, it will be modified to the minimum extent necessary, and remaining provisions remain valid.
12.3 Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
12.4 Assignment: You may not assign these Terms without Our written consent. We may assign these Terms to Our successors.
